These General Terms and Conditions of Hire form an integral part of the hire agreement entered into between Paddock Motorbike (hereinafter, the "Hirer") and the customer (hereinafter the "Lessee"), governing the rights and obligations of both parties during the motorbike hire period. Any amendment, exception or additional agreement to these terms and conditions shall only be valid if expressly set out in writing and accepted by both parties.

Unless otherwise stated, all prices include unlimited mileage and third-party insurance.

Reservation and payment

All bookings require a valid credit card (VISA, MasterCard) for processing. During the online booking process, you have the option to pay via a credit card gateway or by bank transfer. To secure your reservation, 50% of the total payment is required in advance via the online payment system. The remaining 50% will be paid on site at the shop when you collect your rental.

Minimum duration

The minimum hire period is one day. A day is a 24-hour period commencing at the date and time specified in the Hire Agreement. If you return the motorbike more than 30 minutes after the scheduled return time, the lessor shall be entitled to charge for an additional day’s hire at the applicable daily rate set out in the price list.

Return policy

One day’s hire is 24 hours. – If you collect the motorbike at 10.00 am, you must return it before 10.00 am on the agreed day. We do not offer hourly rates or rates for partial days. Even if the motorbike is returned before the agreed hire period has expired, the hire charge agreed in the contract must be paid in full.

Availability guarantee

Once you have made your reservation, you will receive a confirmation by email. This is the guarantee of the availability of the reserved motorbike. However, Paddock Motorbike reserves the right to substitute the requested rental motorbike at any time due to unforeseen circumstances. Paddock Motorbike endeavours to ensure that you ride the motorbike confirmed to you. Unfortunately, sometimes certain unexpected and uncontrollable situations arise; this includes, but is not limited to, mechanical failure, collision damage and theft. In the event that Paddock Motorbike is unable to replace a confirmed motorbike with another motorcycle of the same or similar type, participants will be required to reimburse the difference in service. This constitutes Paddock Motorbike's maximum liability.

Cancellation

During the booking we charge you only the 50% upfront and the rest of the payment is made in our shop during the pick-up. If the cancellation fee is less than what you have already paid, we will refund your card or keep the credit if you wish.

If you cancel your rent

• More than 30 days before the start of your rental, there is no charge.
• Between 29 and 15 days before the start of the rental, 30% of the rental price will be charged.
• Between 14 and 8 days before the start of the rental, you will be charged 50% of the rental price.
• Between 7 and 1 day before the start of the rental, you will be charged 80% of the rental cost.
• If you do not show up, you will be charged 100% of the rent.

Reprogramming

You can change the rental dates once for a fee. You must let us know at least 7 working days in advance and provide us with the new dates, which must be within 12 months of the original dates. The surcharge for changing dates is 20% of the original cost of the rental, with a minimum of 50 euros.

Force majeure

If you are unable to start or need to interrupt the rental for reasons beyond your control, such as natural disasters, long-term strikes, global health alerts or wars:

• If your tenancy has not yet started, we will keep the money you have paid and give you credit towards a future tenancy.
• If your rental has started and has to be interrupted, we will keep the money you have paid and give you credit for the unused portion for a future rental.

This policy ensures that you don't run out of money if things don't go as planned. We are here to help you and make your scooter rental experience as enjoyable as possible.

Obligations of the lessee

The hirer must use the motorbike with due care and attention, comply with the relevant technical regulations and operating instructions, and ensure road safety. The renter must regularly check the oil, water level, tyre pressure, tyre tread and correct tension of the drive chain during the hire period. The renter must comply with legal requirements, in particular the provisions of the Highway Code. The hirer is responsible for complying with driving and health regulations, including holding a valid passport or national identity card, adequate medical insurance and an EU driving licence or an international driving permit for the duration of their stay. The hirer shall be liable for the payment of all administrative fees, fines and penalties arising from their use of the motorbike. Paddock Motorbike may charge an administrative fee of €25 for processing each fine or penalty.
The lessee undertakes to lock the motorbike by locking the handlebars when it is parked. The lessee must stop the vehicle as soon as possible when any warning light indicating an anomaly in its operation comes on, and must contact the lessor as soon as possible by calling the telephone numbers provided.

The lessee is prohibited:

• Permitting the use of the motorbike by any person who has not been previously authorised in the rental agreement.
• Permitting the use of a motorbike by any person who is not fit to ride or who does not have a valid driving licence or is in an unfit state to ride.
• Driving the motorbike by oneself, without being qualified to do so or without having a valid driving licence.
• Use of the motorbike in unsuitable conditions
• Use of the motorbike for commercial activities, the transport of goods or passengers for profit, courier services or any other professional activity not authorised by the lessor.
• Participating with the motorbike in motorcycling events of any kind, including practice or test rides in such events
• Riding the motorbike off-road (on unpaved tracks) or on circuits or beaches.
• Pawning or selling the motorbike in whole or in part, its equipment, accessories and documentation, in any way that infringes the lessor's ownership rights or any other rights the lessor may have in the motorbike.
• Making any technical modifications to the vehicle
• Modifying the appearance of the motorbike by means of paint, stickers, vinyl decals or any other item attached permanently or in such a way as to cause damage to the vehicle (including adhesive mounts for cameras or other accessories).
• Removing the motorbike from the Canary Islands without the lessor’s express authorisation.
• It is expressly forbidden to transport the motorbike to other islands without written authorisation.

Obligations and liability of the lessee

The Hirer shall return the motorbike in a technically sound condition, roadworthy and clean. The Hirer shall also receive the vehicle’s documentation and tools. The Hirer shall acknowledge and accept any existing damage only if it is specified in writing on the damage report form as part of the handover procedure. If, for reasons beyond the Lessee’s control, a repair is necessary during the hire period to ensure the motorcycle’s functionality or to maintain its roadworthiness, the Lessee must obtain the Lessor’s consent before proceeding with the repair. Other claims, regardless of any legal basis, are excluded unless the damage or loss suffered by the Hirer is attributable to wilful misconduct or gross negligence on the part of the Lessor. The Lessee shall be liable for any damages caused by a breach of the obligations assumed under this contract, without prejudice to any limitations on liability arising from the cover provided by the insurance policy taken out, where applicable.

Lessee's liability for damages

From the time of collection until the return of the motorbike. The Hirer shall be liable to the Lessor even for the slightest negligence or carelessness in respect of the disappearance (including loss or confiscation) of the motorbike, as well as for all damage (such as damage caused by an accident or normal wear and tear, damage resulting from improper use, and damage that reduces the value of the motorbike) occurring beyond the scope of normal wear and tear during the hire period. In the event of damage to the hired motorbike, the Hirer shall be liable for the repair, invoicing and return costs actually incurred or determined by an expert assessment, as well as for the costs of the expert assessment, the reduction in technical and market value, up to the amount of the chosen excess option.

The hirer is solely liable for any damage to the tyres (punctures) occurring during the hire period. The cost of replacing the damaged tyre shall be borne by the hirer, even if the damage is only discovered when the motorbike is returned. The amount payable will be calculated based on the wear and tear of the replaced tyre. For example: if the cost of replacing the tyre is €150 and the old tyre still had a tread depth of 50%, the hirer must pay 50% of the costs, i.e. €75 in this case.

The hirer is liable for all damage caused whilst driving off-road, on race tracks or on beaches. They are also liable for all damage caused by improper use. Furthermore, the hirer is liable in full for any obvious disproportionate wear and tear (tyres/clutch) resulting from improper use or manoeuvres such as deliberate skidding, acceleration resulting in loss of traction ("burnouts") or other similar practices. In the event of damage caused in this way, the amount of the claim is not limited by the comprehensive insurance excess.

The hirer is also liable for any damage to or loss of the hired equipment (GoPro, helmets, motorcycling gear, keys) up to the full amount of the damage caused.

If the motorbike becomes unrideable or unusable due to damage caused by the Hirer or an action caused by the Hirer, the Hirer shall not be entitled to a replacement motorbike for the remainder of the rental period. Furthermore, in this case he shall not be entitled to a refund of the rental price.

Requirements in the event of an accident or other damage

In the event of damage or loss, as well as in the event of breakdown or accident, the Hirer is obliged to notify the Lessor immediately by telephone. Towing and/or repair services may only be requested with the consent of Paddock Motorbike. The police must be notified immediately in the event of an accident. Evidence will be secured (witnesses, track markings, etc.), the personal details of those involved will be recorded and everything that can contribute to the correct and complete clarification of the sequence of events will be done. The hirer undertakes not to admit guilt or to take any other actions (payments, comparisons) that could jeopardise the insurance cover.

Insurance coverage

The hirer undertakes to assume financial responsibility up to the amount of his chosen insurance option (basic or limited liability) in the event of damage to the motorbike. The deposit deposited with Paddock Motorbike shall serve as security for payment. The lessee is expressly reminded that, despite the limited liability insurance, he remains liable for damages in the following cases:

1. If you do not comply with the provisions of the contractual agreement as stipulated in the section "Obligations of the lessee".
2. leaves the scene of the accident in which he has been involved
3. Causing damage intentionally, wilfully or through gross negligence
4. Exceeds the agreed rental period, contrary to the contract.

Basic third party insurance

The insurance The basic insurance included in the rental price is a third party insurance of the vehicle which includes the following:

1. Third party vehicle insurance only. In the event of damage, accident, fire or theft, the driver of the vehicle is liable to pay all costs incurred by the damage or total loss of the vehicle.
2. Third party insurance with full coverage in the event of an accident. Covers vehicles, drivers and passengers up to €50,000,000 per accident.
3. These clauses may cease to be valid in the following cases:
   - The vehicle is driven under the influence of alcohol, drugs, narcotics or other psychoactive substances.
   - The vehicle is driven in places not authorised by the rental company, in this case, off-road, forest tracks, any unpaved road, beaches or on a racetrack.
   - The Tenant fails to comply with any of the obligations set out in the section "Tenant’s obligations".

Limited Liability Insurance

Limited Liability Insurance is optional at the time of hire; the cost varies depending on the motorbike. It is comprehensive insurance for the vehicle, with an excess of €1,200 or €2,000 depending on the model, and includes the following:

1. Fully comprehensive vehicle insurance in the event of damage, accident, fire or theft, with an excess of €1200/2000. This means that the owner of the vehicle is responsible for paying up to €1200/2000 of the costs incurred by the damage or total loss of the vehicle. The rest is covered by the insurance.
2. Third party insurance with full coverage in the event of an accident. Covers third party vehicles, drivers and passengers up to €50,000,000 per accident.
3. The driver is the only one covered by insurance.
4. These clauses may cease to be valid in the following cases:
   1. Driving under the influence of alcohol, drugs, narcotics or other psychoactive substances.
   2. Driving in places not authorised by the rental company, in this case, off-road, forest tracks, any unpaved road, beaches or on a racetrack.
   3. The lessee does not comply with one of the obligations set out in section 6.

Travel insurance

We recommend that you take out appropriate travel, health and accident insurance as well as travel cancellation insurance.

Return of the motorbike

The motorbike must be returned with no visible external damage. The Hirer shall return the motorbike in the same condition at the end of the hire period at the agreed location and time, together with all vehicle documents, tools and accessories. The Lessor may terminate the hire agreement with immediate effect should the Hirer be in serious breach of these terms and conditions, provide false details, or should any other circumstances arise that render the continuation of the hire impossible or inadvisable. In such a case, the Hirer must return the motorbike immediately, without prejudice to any applicable legal action. Compelling reasons include, in particular, incorrect personal details provided by the Hirer, information regarding creditworthiness, as well as a serious breach of the provisions of the rental agreement. In the event of termination without prior notice, the hire motorcycle must be returned immediately, i.e. before the agreed hire period has elapsed. The Hirer’s right to claim damages remains unaffected.

1. The renter agrees to assume financial responsibility for all traffic offences incurred on his rental motorbike for the duration of his rental period. All fines will be subject to a €25 processing fee by Paddock Motorbike.
2. The hirer accepts the payment of a fee of 15 euros per motorbike for pick-ups outside Paddock Motorbike's normal opening hours (i.e. weekends and/or national and local public holidays). This fee is payable directly to the rental agent who deals with the hirer's request to carry out the activity outside Paddock Motorbike's normal opening hours.
3. In the event of the loss of the vehicle’s documentation, the hirer must pay 100 euros to cover the cost of replacement.
4. The hirer shall be obliged to pay the cleaning costs if the motorbike is unusually dirty and requires professional cleaning.
5. The lessee must return the motorbike with the same tank as he/she received it. Otherwise, a supplement of 15 € will be charged, in addition to the fuel costs.
6.  If the return time is exceeded by more than 30 minutes, the tenant is obliged to pay an additional daily rent per day as compensation.
7. In the event of the loss, theft or damage to the motorcycle keys, the Hirer shall bear the costs arising from their replacement, programming, recovery of the vehicle and any other action necessary to restore it to working order.
8. If any fault warning light comes on during the hire period, the Hirer must stop the motorbike as soon as it is safe to do so and contact Paddock Motorbike immediately. If you continue to ride and this causes further damage, you will be liable for such damage, even if it is not covered by the insurance taken out.
9. If the motorbike is immobilised, impounded by the relevant authority or taken to a storage facility as a result of an act attributable to the Hirer, the Lessee shall bear all resulting costs, including those relating to removal, storage, transport, fines and any financial loss incurred by Paddock Motorbike, including loss of income resulting from the immobilisation of the vehicle.

Authorisation for additional charges

The Hirer expressly authorises Paddock Motorbike to charge the relevant amounts to the credit or debit card provided as security, or to retain all or part of the security deposit, where there are outstanding amounts arising from this contract, including, but not limited to, damage caused to the vehicle or its accessories, insurance excesses, fuel, extra cleaning, loss of keys or documentation, fines, penalties, administrative fees, late returns, tolls, transport costs or any other breach of the rental terms and conditions. Such charges shall be duly substantiated by means of an invoice, quotation, expert’s report or any other supporting document.

Data protection

The personal data provided by the Hirer will be processed by Paddock Motorbike for the purposes of managing the booking, formalising the hire agreement, complying with applicable legal obligations and dealing with any issues arising from the service provided. The processing of data will be carried out in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on the Protection of Personal Data and the Guarantee of Digital Rights. The Hirer may exercise their rights of access, rectification, erasure, objection, restriction of processing and data portability by submitting a request to Paddock Motorbike via the designated contact channels.

Applicable legislation

This contract shall be governed by and construed in accordance with the laws currently in force in Spain.

Communications

The Hirer undertakes to provide accurate contact details and to ensure that the telephone number and email address provided remain valid throughout the hire period. Any communication sent by Paddock Motorbike to these details shall be deemed to have been validly made.

Forgotten objects

Paddock Motorbike shall not be liable for any personal belongings left behind by the Hirer on the motorbike or on its premises. Should any such items be found, they will be held in safekeeping for a maximum of 30 days. Any costs incurred in connection with their dispatch or return shall be borne by the Hirer.

Condition of the vehicle on delivery

The Hirer declares that they have inspected the motorbike at the time of handover and received it in a satisfactory condition in terms of operation, cleanliness and general upkeep, except for any damage expressly noted in the handover report. Signing the contract implies acceptance of the condition of the vehicle and the accessories provided.

Printing and calculation errors

Paddock Motorbike reserves the right to correct printing or calculation errors at any time.
