Terms and conditions and rental contract

These rental terms and conditions are an integral part of the contractual agreement between Paddock Motorbike (Lessor), hereinafter referred to as Paddock Motorbike, and the customer (Lessee), which regulates the use of the motorbikes. Rights to deviations, variations or supplementary provisions, valid only in writing, are reserved.

Unless otherwise stated, all prices include unlimited kilometres (mileage), third party insurance and local IGIC tax.

Reservation and payment

All bookings require a valid credit card (VISA, MasterCard) for processing. During the online booking process, you have the option to pay via a credit card gateway or by bank transfer. To secure your reservation, 50% of the total payment is required in advance via the online payment system. The remaining 50% will be paid on site at the shop when you collect your rental.

Minimum duration

The minimum Rental Period is one day. A day is a 24-hour day starting at the date and time indicated on the Rental Agreement. If you return the Motorcycle more than 30 minutes after the scheduled return time, we reserve the right to charge you for an additional day's rental at the applicable daily rate shown in the price list.

Return policy

A rental day is 24 hours. - If you pick up your bike at 10:00 AM, you must return it by 10:00 AM on the agreed day. We do not offer hourly or partial day rates. Even if the bike is returned before the agreed rental period has expired, the rental amount agreed in the contractual agreement must be paid in full.

Availability guarantee

Once you have made your reservation, you will receive a confirmation by email. This is the guarantee of the availability of the reserved motorbike. However, Paddock Motorbike reserves the right to substitute the requested rental motorbike at any time due to unforeseen circumstances. Paddock Motorbike endeavours to ensure that you ride the motorbike confirmed to you. Unfortunately, sometimes certain unexpected and uncontrollable situations arise; this includes, but is not limited to, mechanical failure, collision damage and theft. In the event that Paddock Motorbike is unable to replace a confirmed motorbike with another motorcycle of the same or similar type, participants will be required to reimburse the difference in service. This constitutes Paddock Motorbike's maximum liability.

Cancellation

During the booking we charge you only the 50% upfront and the rest of the payment is made in our shop during the pick-up. If the cancellation fee is less than what you have already paid, we will refund your card or keep the credit if you wish.

If you cancel your rent

  • More than 30 days before the start of your rental, there is no charge.
  • Between 29 and 15 days before the start of the rental, 30% of the rental price will be charged.
  • Between 14 and 8 days before the start of the rental, you will be charged 50% of the rental price.
  • Between 7 and 1 day before the start of the rental, you will be charged 80% of the rental cost.
  • If you do not show up, you will be charged 100% of the rent.

Reprogramming

You can change the rental dates once for a fee. You must let us know at least 7 working days in advance and provide us with the new dates, which must be within 12 months of the original dates. The surcharge for changing dates is 20% of the original cost of the rental, with a minimum of 50 euros.

Force majeure

If you are unable to start or need to interrupt the rental for reasons beyond your control, such as natural disasters, long-term strikes, global health alerts or wars:

  • If your tenancy has not yet started, we will keep the money you have paid and give you credit towards a future tenancy.
  • If your rental has started and has to be interrupted, we will keep the money you have paid and give you credit for the unused portion for a future rental.

This policy ensures that you don't run out of money if things don't go as planned. We are here to help you and make your scooter rental experience as enjoyable as possible.

Obligations of the lessee

The Hirer shall use the motorbike with due care and attention, observe the appropriate technical codes and operating instructions and ensure road safety. Oil, water level, tyre pressure, tyre profile and correct drive chain tension shall be checked regularly by the Hirer during the rental period. The Hirer must comply with the legal requirements, in particular the provisions of the road traffic regulations. The Hirer is responsible for complying with driving and health regulations, including having a valid passport or national identity card, adequate health insurance and an EU driving licence or an international driving licence for the duration of his stay. The Hirer shall be responsible for the payment of all administrative fees, fines and penalties attributable to his use of the motorbike. The Hirer is free to charge a processing fee of 25 Euro per penalty.
The lessee undertakes to lock the motorbike by locking the handlebars when it is parked. The lessee must stop the vehicle as soon as possible when any warning light indicating an anomaly in its operation comes on, and must contact the lessor as soon as possible by calling the telephone numbers provided.

The lessee is prohibited:

  • Permitting the use of the motorbike by any person who has not been previously authorised in the rental agreement.
  • Permitting the use of a motorbike by any person who is not fit to ride or who does not have a valid driving licence or is in an unfit state to ride.
  • Driving the motorbike by oneself, without being qualified to do so or without having a valid driving licence.
  • Use of the motorbike in unsuitable conditions
  • Use of the motorbike for commercial purposes
  • Participating with the motorbike in motorcycling events of any kind, including practice or test rides in such events
  • Use the motorbike off-road (unpaved roads) or on circuits or beaches.
  • Pawning or selling the motorbike in whole or in part, its equipment, accessories and documentation, in any way that infringes the lessor's ownership rights or any other rights the lessor may have in the motorbike.
  • Making any technical modifications to the vehicle
  • Changing the appearance of the vehicle, including in particular the paintwork, stickers, adhesive films or various media (GoPro, etc.). In this case, the Hirer is free to charge the corresponding cleaning fee.
  • Travelling by motorbike to African countries, such as Morocco.
  • Travelling by motorbike to other islands without prior notice.

Obligations and liability of the lessee

The lessee shall hand over the motorbike in a technically correct, roadworthy and clean condition. The lessee shall also receive the vehicle documents and tools. The lessee shall only acknowledge and accept existing damages if they are defined in writing on the damage form as part of the handover procedure. If, for reasons beyond the Lessee's control, repairs are necessary during the rental period to ensure the function or to maintain the roadworthiness of the motorbike, the Lessee must receive the consent of the Lessor before proceeding with the repair. Further claims, irrespective of any legal reason, are excluded unless the damage or loss to the lessee is attributable to intent or gross negligence on the part of the lessor. The Tenant's liability for default and non-performance is limited to the rental price. Further claims on any legal grounds are excluded.

Lessee's liability for damages

From the time of collection until the return of the motorbike, the Lessee shall be liable to the Lessee for even the slightest negligence/neglect regarding the disappearance (including loss or confiscation) of the motorbike, as well as for all damage (such as accident or operational damage, damage as a result of improper use and damage that reduces the value of the motorbike) that occurs beyond the scope of normal wear and tear of the motorbike during the rental period. In the event of damage to the rented motorbike, the Hirer shall be liable for the costs of repair, invoicing and return actually incurred or defined by an expert appraisal, as well as for the appraisal costs, the reduction of the technical and market value up to the amount of the chosen damage excess option. The Hirer shall bear the burden of proof for minor damage.

The Hirer is solely responsible for any damage to the tyres (punctures) during the rental period. The replacement of the damaged tyre shall be at the Hirer's expense, even if the damage is determined at the time of return of the motorbike. The value of the tyre will be calculated according to the profile of the remaining tyre. As an example: if the replacement of the tyre costs €150 and the old tyre still had a profile of 50%, the lessee must pay 50% of the costs, i.e. in this case €75.

The hirer is liable for all damage caused by driving off-road, on racetracks or on beaches. He is also liable for all damage caused by improper use. As well as for obvious disproportionate wear (tyre/clutch) due to improper use (such as "burnouts"), the renter is liable for these damages in full. In the event of damage caused in this way, the amount of the damage is not limited by the comprehensive insurance excess.

The renter is also liable for damages and loss of rented accessories (Gopro, helmets, motorbike clothing, keys) for the total amount of the damage caused.

If the motorbike becomes unrideable or unusable due to damage caused by the Hirer or an action caused by the Hirer, the Hirer shall not be entitled to a replacement motorbike for the remainder of the rental period. Furthermore, in this case he shall not be entitled to a refund of the rental price.

Requirements in the event of an accident or other damage

In the event of damage or loss, as well as in the event of breakdown or accident, the Hirer is obliged to notify the Lessor immediately by telephone. Towing and/or repair services may only be requested with the consent of Paddock Motorbike. The police must be notified immediately in the event of an accident. Evidence will be secured (witnesses, track markings, etc.), the personal details of those involved will be recorded and everything that can contribute to the correct and complete clarification of the sequence of events will be done. The hirer undertakes not to admit guilt or to take any other actions (payments, comparisons) that could jeopardise the insurance cover.

Insurance coverage

The hirer undertakes to assume financial responsibility up to the amount of his chosen insurance option (basic or limited liability) in the event of damage to the motorbike. The deposit deposited with Paddock Motorbike shall serve as security for payment. The lessee is expressly reminded that, despite the limited liability insurance, he remains liable for damages in the following cases:

  1. If you do not comply with the provisions of the contractual agreement as stipulated in the section "Obligations of the lessee".
  2. leaves the scene of the accident in which he has been involved
  3. Causing damage intentionally, wilfully or through gross negligence
  4. Exceeds the agreed rental period, contrary to the contract.

Basic third party insurance

The insurance The basic insurance included in the rental price is a third party insurance of the vehicle which includes the following:

  1. Third party vehicle insurance only. In the event of damage, accident, fire or theft, the driver of the vehicle is liable to pay all costs incurred by the damage or total loss of the vehicle.
  2. Third party insurance with full coverage in the event of an accident. Covers vehicles, drivers and passengers up to €50,000,000 per accident.
  3. These clauses may cease to be valid in the following cases:
    - The vehicle is driven under the influence of alcohol, drugs, narcotics or other psychoactive substances.
    - The vehicle is driven in places not authorised by the rental company, in this case, off-road, forest tracks, any unpaved road, beaches or on a racetrack.
    - The Lessee does not comply with any of the obligations set out in Section 6.

Limited Liability Insurance

The Limited Liability Insurance is optional to be contracted at the time of rental, it has a cost of 6€ per rental day, it is a fully comprehensive insurance for the vehicle, with an excess of 1200€/2000€ depending on the model, which includes the following:

  1. Fully comprehensive vehicle insurance in the event of damage, accident, fire or theft, with an excess of €1200/2000. This means that the owner of the vehicle is responsible for paying up to €1200/2000 of the costs incurred by the damage or total loss of the vehicle. The rest is covered by the insurance.
  2. Third party insurance with full coverage in the event of an accident. Covers third party vehicles, drivers and passengers up to €50,000,000 per accident.
  3. The driver is the only one covered by insurance.
  4. These clauses may cease to be valid in the following cases:
    1. Driving under the influence of alcohol, drugs, narcotics or other psychoactive substances.
    2. Driving in places not authorised by the rental company, in this case, off-road, forest tracks, any unpaved road, beaches or on a racetrack.
    3. The lessee does not comply with one of the obligations set out in section 6.

Return of the motorbike

The motorbike shall be returned without externally visible deficiencies. The lessee shall return the motorbike in the same condition at the end of the rental period at the agreed place and time with all vehicle documents, tools and accessories. The Lessee shall have the right to terminate the rental contract without notice if a compelling reason is known which makes the continuation of the rental contract unacceptable. Compelling reasons include, in particular, incorrect personal data of the Hirer, information on creditworthiness, as well as serious infringement of the provisions of the contractual agreement. In the event of termination without notice, the rental motorbike must be returned immediately, i.e. before the agreed rental period has expired. The Tenant's right to claim damages shall remain unaffected.

  1. The renter agrees to assume financial responsibility for all traffic offences incurred on his rental motorbike for the duration of his rental period. All fines will be subject to a €25 processing fee by Paddock Motorbike.
  2. The hirer accepts the payment of a fee of 15 euros per motorbike for pick-ups outside Paddock Motorbike's normal opening hours (i.e. weekends and/or national and local public holidays). This fee is payable directly to the rental agent who deals with the hirer's request to carry out the activity outside Paddock Motorbike's normal opening hours.
  3. In the event of loss of the vehicle's documents, the Hirer shall be obliged to pay 100 euros in replacement costs. The lessee shall be obliged to pay cleaning costs if the motorbike is very dirty.
  4. The lessee must return the motorbike with the same tank as he/she received it. Otherwise, a supplement of 15 € will be charged, in addition to the fuel costs.
  5.  If the return time is exceeded by more than 30 minutes, the tenant is obliged to pay an additional daily rent per day as compensation.

Travel insurance

We recommend that you take out appropriate travel, health and accident insurance as well as travel cancellation insurance.

Printing and calculation errors

Paddock Motorbike reserves the right to correct printing or calculation errors at any time.
