Rental Conditions and Contract

These rental conditions are an integral part of the contractual agreement between Paddock Motorbike (Lessor), hereinafter Paddock Motorbike, and the customer (Lessee), which regulates the use of the motorcycles. The right to deviations, variations or additional provisions is reserved, valid only in writing.

Unless otherwise stated, all prices include unlimited kilometers (mileage), third party insurance and local IGIC tax.

Booking and Payment

All reservations require a valid credit card (VISA, MasterCard) for processing. During the online booking process, you have the option to pay via a credit card gateway or by bank transfer. To guarantee your reservation, 50% of the total payment is required in advance via the online payment system. The remaining 50% is to be paid on site in the store when you pick up your rental.

Minimum Duration

The minimum Rental Period is one day. A day is a 24-hour day starting on the date and time stated in the Rental Agreement. If you return the Motorcycle more than 30 minutes after the scheduled return time, we reserve the right to charge you an additional rental day at the applicable daily rate listed in the price list.

Return Policy

A rental day is 24 hours. – If you pick up the bike at 10:00 AM, you must return it by 10:00 AM on the agreed day. We do not offer hourly or partial day rates. Even if the motorcycle is returned before the agreed rental period has expired, the rental amount agreed in the contractual agreement must be paid in full.

Availability Guarantee

Once the reservation has been made, you will receive a confirmation by email. This is the guarantee of the availability of the reserved motorcycle. However, Paddock Motorbike reserves the right to substitute the requested rental motorcycle at any time due to unforeseen circumstances. Paddock Motorbike strives to ensure that you ride the motorcycle that has been confirmed to you. Unfortunately, sometimes certain unexpected and uncontrollable situations arise; this includes, but is not limited to, mechanical failures, collision damage and theft. In the event that Paddock Motorbike is unable to replace a confirmed motorcycle with another of the same or similar type, participants will be required to reimburse the difference in service. This constitutes the maximum liability of Paddock Motorbike.

Cancellation

During booking we charge you only 50% in advance and the rest of the payment is made in our shop during pick-up. If the cancellation fee is less than what you have already paid, we will refund it to your card or keep the credit if you wish.

If you cancel your rental

  • More than 30 days before the start of your rental, there is no charge.
  • Between 29 and 15 days before the start of the rental, you will be charged 30% of the rental price.
  • Between 14 and 8 days before the start of the rental, you will be charged 50% of the rental price.
  • Between 7 and 1 day before the start of the rental, you will be charged 80% of the rental cost.
  • If you do not show up, you will be charged 100% of the rental.

Rescheduling

You can change the rental dates once by paying a surcharge. You must notify us at least 7 working days in advance and provide us with the new dates, which must be within 12 months of the original dates. The surcharge for changing dates is 20% of the original rental cost, with a minimum of 50 euros.

Force majeure

If you are unable to start or need to interrupt the rental due to causes beyond your control, such as natural disasters, long-term strikes, global health alerts or wars:

  • If your rental has not yet started, we will keep the money you have paid and give you credit for a future rental.
  • If your rental has started and has to be interrupted, we will keep the money you have paid and give you credit for the unused portion towards a future rental.

This policy ensures that you are not left out of pocket if things don’t go as planned. We are here to help you and make your motorcycle rental experience as pleasant as possible.

Renter’s Obligations

The renter must use the motorcycle with due care and attention, observe the appropriate technical codes and operating instructions, and ensure road safety. The oil, water level, tire pressure, tire profile and correct drive chain tension must be checked regularly by the renter during the rental period. The renter must comply with legal requirements, especially the provisions of the highway code. The renter is responsible for complying with driving and health regulations, including having a valid passport or national identity card, adequate health insurance and an EU driving license or an international driving license for the duration of his stay. The renter will be responsible for paying all administrative fees, fines and penalties that are attributed to his use of the motorcycle. The renter is free to charge a processing fee of 25 euros per penalty.
The renter undertakes to lock the motorcycle by locking the handlebars when it is parked. The lessee must stop the vehicle as soon as possible when any warning light indicating an anomaly in its operation comes on, and must contact the lessor as soon as possible by calling the telephone numbers provided.

The lessee is prohibited from:

  • Allowing the use of the motorcycle to any person who has not been previously authorized in the rental contract.
  • Allowing the use of the motorcycle to any person who is not qualified to drive or who does not have a valid driving license or is in a state unfit for driving.
  • Driving the motorcycle by himself, without being qualified to do so or without having a valid driving license.
  • Using the motorcycle in inappropriate conditions
  • Using the motorcycle for commercial purposes
  • Participating with the motorcycle in motorcycling events of any kind, including practices or tests for these events
  • Using the motorcycle off-road (unpaved roads) or on circuits or beaches.
  • Pawning or selling the motorcycle in whole or in part, its equipment, accessories and documentation, in any way that infringes the lessor’s property rights or any other rights the lessor has over the motorcycle.
  • Making any technical modifications to the vehicle
  • Changing the appearance of the vehicle, including in particular the paint, stickers, adhesive films or various supports (GoPro, etc.). In this case, the lessee is free to charge the corresponding cleaning fee.
  • Travelling by motorcycle to African countries, such as Morocco.
  • Travelling by motorcycle to other islands without prior notice.

Obligations and liability of the lessee

The lessee shall hand over the motorcycle in a technically correct, roadworthy and clean condition. The lessee shall also receive the vehicle documents and tools. The lessee shall acknowledge and accept existing damage only if it is defined in writing on the damage form as part of the handover procedure. If, through no fault of the lessee, a repair is necessary during the rental period to ensure the operation or maintain the roadworthiness of the motorcycle, the lessee must obtain the consent of the lessor before proceeding with the repair. Other claims, regardless of any legal reason, are excluded unless the damage or loss to the lessee is attributed to intent or gross negligence on the part of the lessor. The liability of the lessee for non-performance and non-performance is limited to the rental price. Other claims for any legal reason are excluded.

Liability of the renter for damages

From the time of pick-up to the return of the motorcycle, the Renter shall be liable to the Renter even for the slightest negligence/carelessness regarding the disappearance (including loss or confiscation) of the motorcycle, as well as for all damages (such as damages due to accident or operation, damages as a result of improper use and damages that reduce the value of the motorcycle) that occur beyond the scope of normal wear and tear of the motorcycle during the rental period. In the event of damage to the rented motorcycle, the Renter shall be liable for the repair, billing and return costs actually incurred or defined by an appraisal, as well as for the appraisal costs, the reduction of the technical and market value up to the amount of the chosen damage deductible option. The burden of proof of minor damage shall be on the renter.

The renter is solely responsible for damages that occur to the tires (punctures) during the rental period. The replacement of the damaged tyre will be the responsibility of the renter, even if the damage is determined at the time of the return of the motorcycle. The value of the tyre will be calculated based on the profile of the remaining tyre. As an example: if the replacement of the tyre costs €150 and the old tyre still had a profile of 50%, the renter will have to pay 50% of the costs, i.e. in this case €75.

The renter is responsible for all damage caused by off-road driving, on racetracks or on beaches. He is also responsible for all damage caused by improper use. As well as for obvious disproportionate wear (tyre / clutch) due to improper use (such as „burnouts“), the renter is responsible for these damages in full. In the event of damage caused in this way, the amount of damage is not limited by the deductible of the comprehensive insurance.

The renter is also liable for damage and loss of rented accessories (Gopro, helmets, motorcycle clothing, keys) for the full amount of the damage caused.

If the motorcycle becomes unfit for riding or cannot be used due to damage caused by the renter or an action caused by the renter, the renter will not be entitled to a replacement motorcycle for the remainder of the rental period. In addition, in this case he will not be entitled to a refund of the rental price.

Requirements in the event of an accident or any other damage

In the event of damage or loss, as well as in the event of a breakdown or accident, the Lessee is obliged to immediately notify the Lessor by telephone. Towing and/or repair services may only be requested with the consent of Paddock Motorbike. The police must be notified immediately in the event of an accident. Evidence (witnesses, road markings, etc.) will be secured, the personal data of those involved will be recorded and everything will be done that can contribute to the correct and complete clarification of the sequence of events. The Lessee undertakes not to admit any guilt or to take any other actions (payments, comparisons) that could jeopardize the insurance coverage.

Insurance coverage

The Lessee undertakes to assume financial responsibility up to the amount of his chosen insurance option (basic or limited liability) in the event of damage to the motorcycle. The deposit deposited with Paddock Motorbike will serve as a guarantee of payment. The lessee is expressly reminded that, despite the limited liability insurance, he remains liable for damages in the following cases:

If he fails to comply with the provisions of the contractual agreement stipulated in the section „Obligations of the lessee.“

  1. Causes damage intentionally, deliberately or through gross negligence
  2. Exceeds the agreed rental period, contrary to what is stipulated in the contract
  3. Leaves the scene of the accident in which he has been involved
  4. Causes damage intentionally, deliberately or through gross negligence

Basic third party insurance

The basic insurance included in the rental price is third party vehicle insurance which includes the following:

  1. Only third party vehicle insurance. In the event of damage, accident, fire or theft, the driver of the vehicle is responsible for paying all expenses incurred by the damage or total loss of the vehicle.
  2. Third party insurance with full coverage in the event of an accident. It covers vehicles, drivers and passengers up to €50,000,000 per accident.
  3. These clauses may cease to be valid in the following cases:
    – The vehicle is driven under the influence of alcohol, drugs, narcotics or other psychoactive substances.
    – The vehicle is driven in places not authorised by the rental company, in this case, off-road, forest tracks, any unpaved road, beaches or on a race track.
    – The Lessee fails to comply with any of the obligations indicated in Section 6. Obligations of the Lessee

Limited Liability Insurance

Limited Liability Insurance is optional to be purchased at the time of rental, costs €6 per day of rental, is a comprehensive insurance for the vehicle, with a deductible of €1200/€2000 depending on the model, which includes the following:

  1. Comprehensive vehicle insurance in case of damage, accident, fire or theft, with a deductible of €1200/€2000. This means that the vehicle owner is responsible for paying up to €1200/€2000 of the expenses caused by damage or total loss of the vehicle. The rest is covered by the insurance.
  2. Third party insurance with full coverage in case of accident. It covers third party vehicles, drivers and passengers up to €50,000,000 per accident.
  3. The driver is the only one covered by the insurance.
  4. These clauses may cease to be valid in the following cases:
    -Driving under the influence of alcohol, drugs, narcotics or other psychoactive substances.
    -Driving in places not authorised by the rental company, in this case, off-road, forest tracks, any unpaved road, beaches or on a race track.
    -The lessee does not comply with any of the obligations established in section 6. Obligations of the lessee.

Return of the motorcycle

The motorcycle must be returned without externally visible defects. The Renter shall return the motorcycle in the same condition at the end of the rental period at the agreed place and time with all vehicle documents, tools and accessories. The Renter shall be entitled to terminate the rental agreement without notice if a compelling reason becomes known that makes the continuation of the rental agreement unacceptable. Compelling reasons include, in particular, incorrect personal data of the Renter, information on creditworthiness as well as serious violation of the provisions of the contractual agreement. In the event of termination without notice, the rental motorcycle must be returned immediately, i.e. before the agreed rental period has elapsed. The Renter’s right to claim damages shall not be affected.

  1. The Renter undertakes to assume financial responsibility for all traffic violations incurred on his rental motorcycle during the duration of his rental period. All fines will be subject to a €25 processing fee by Paddock Motorbike.
  2. The renter agrees to pay a fee of €15 per motorcycle for pick-ups outside of normal Paddock Motorbike hours (i.e. weekends and/or national and local holidays). This fee will be paid directly to the rental agent who handles the renter’s request to perform the activity outside of normal Paddock Motorbike hours.
  3. In the event of loss of vehicle documentation, the renter will be required to pay €100 for replacement costs. The renter will be required to pay cleaning costs if the motorcycle is very dirty.
  4. The renter must return the motorcycle with the tank in the same condition as received. Otherwise, an additional €15 will be charged, in addition to fuel costs.
  5. If the return time is exceeded by more than 30 minutes, the renter is required to pay an additional daily rental per day as compensation.

Travel Insurance

We recommend that you take out suitable travel, illness and accident insurance, as well as travel cancellation insurance.

Printing and calculation errors

Paddock Motorbike reserves the right to correct printing or calculation errors at any time.
